About the Judges on Your Ballot Oklahomans re-elect judges using the judicial retention system. Voters simply indicate 'yes' or 'no' on whether a Supreme Count justice or appellate judge should be retained in office based on your view of their performance. If an appellate judge does not receive a majority of 'yes' votes, the office becomes vacant and the governor appoints a replacement. Appellate judges cannot be listed on the ballot by their political party and are prohibited by law from publically stating their political affiliation.
